Under the MERIT CLASS ACTION SETTLEMENT, owners of homes built by Merit Development, Inc., d/b/a Merit Homes, Kenneth Babcock and John McCormac had the potential availability of benefits as they relate to the Slab Repair/Slab Replacement of their basement slab due to expansive soils.  Also, a Payment in Lieu was available rather than the owner opting for the right to receive a payment toward slab repair/replacement. 

More detailed and precise terms of the Settlement are available as outlined in the 1997 Civil Action No. 95 CV 1417-5 at the Boulder District Court.

The Merit Settlement finalized on December 4, 2003.  No additional claims may be submitted.
